Civil Legal Liability of the Airline to Passengers in the Sriwijaya Air SJ182 Plane Crash
Abstract
The Sriwijaya Air SJ-182 plane crash on 9 January 2021 raised legal issues concerning the form of liability borne by the airline toward passengers who became victims. This incident demonstrates that although air transportation is supported by advanced technology and high safety standards, the risk of accidents cannot be entirely eliminated, making the issue of legal liability an important subject of study. This research aims to analyze the application of the legal liability system and to examine its strengths and weaknesses in the Sriwijaya Air SJ-182 accident case. The research employs normative legal research using a statutory approach and a conceptual approach. The findings indicate that compensation for the victims of the Sriwijaya Air SJ-182 crash is based on the principle of strict liability, under which the airline is obligated to provide compensation without the need to prove fault. This system offers advantages in terms of legal certainty and facilitating victims’ access to compensation. However, it also has limitations, as the amount of compensation is capped and does not fully accommodate non-material damages or the liability of other parties beyond the airline.
