Application of Contract Law Principles in Electronic Contracts in Digital Transactions

The increase in digital transactions through electronic wallets requires an in-depth analysis of the application of contract law principles. This study aims to analyze how contract law principles are applied in electronic contracts in digital wallet services. The method used is normative juridical with a legislative and literature study approach, on the electronic contract documents of each application. The results of the study show that all three applications still place users in a weak position. DANA implements automatic consent for personal data, GOPAY grants the right to unilaterally change services while imposing risks on users, while OVO exempts itself from liability for losses and enforces transaction finality. These clauses are not fully aligned with the principles of consensualism, good faith, and balance, as users have no room for negotiation and proportional legal protection. As a result, the contractual relationship tends to be imbalanced and more favorable to the service provider.
