ANALISIS YURIDIS EKSEKUSI JAMINAN FIDUSIA DALAM PEMBIAYAAN SEPEDA MOTOR

This study aims to analyze the legal consequences of enforcement actions taken by financing companies and debt collectors in motorcycle sales agreements through consumer financing schemes, as well as to understand the role and function of fiduciary guarantees in relation to collateral. In practice, there are many cases of unilateral repossession of motor vehicles by leasing companies without going through legal mechanisms. This study uses a normative legal approach with a literature study method and relies on primary, secondary, and tertiary legal materials. The results of the study indicate that the execution of fiduciary guarantees without a fiduciary certificate and without going through the courts is a violation of the law. The execution of fiduciary guarantee objects that are not voluntarily surrendered by the debtor must go through the judicial process. Unilateral execution by debt collectors without a valid legal basis can be categorized as an unlawful act and is detrimental to the debtor. On the other hand, fiduciary guarantees have an important function in ensuring legal certainty and protection for creditors and providing easy access to financing for the public. Therefore, it is important for all parties involved in consumer financing to carry out legal procedures correctly so that the rights and obligations of each party remain protected.
