IMPLEMENTASI KEWAJIBAN PEMBAYARAN ROYALTI MUSIK PADA USAHA KAFE DI KOTA PALU

This study aims to identify the implementation of royalty payment obligations for the utilization of songs and/or music in cafes in Palu City. The research method applied is empirical legal research, utilizing interviews, observation, and documentation techniques on several cafe business owners in Palu City. The research focus is directed at the royalty payment obligation for the commercial use of songs and/or music. Based on the research findings from several cafes, namely Intime Coffee La, Toko Kopi Reto, Dafis Coffee and Eat, Sin Coffee and Eatery, Box Coffee, Roviga Corner, and Kopte Kafe, it was found that the implementation of royalty payment obligations has not been carried out optimally due to the low understanding of business owners regarding copyright provisions. In addition to the still low level of compliance, the inhibiting factors include weak law enforcement and the suboptimal functioning of the Song and/or Music Data Center managed under the Directorate General of Intellectual Property (DJKI). Thus, it can be concluded that the implementation of royalty payment obligations for the commercial utilization of songs and/or music in the seven cafes in Palu City has not been effective. The observed obstacles are primarily caused by weak implementation and poor coordination among related institutions, rather than the lack of a legal basis or regulation.
