IMPLEMENTASI KONVENSI PERSERIKATAN BANGSA-BANGSA TENTANG KEJAHATAN TRANSNASIONAL TERHADAP PERLINDUNGAN WNI KORBAN HUMAN TRAFFICKING

Abstract:
This research focuses on analyzing legal protection for Indonesian citizens (WNI) who are victims of human trafficking in Myanmar based on the provisions of the United Nations Convention Against Transnational Organized Crime (UNTOC) and the Protocol to Prevent, Suppress, and Punish Trafficking in Persons, Especially Women and Children (Palermo Protocol). The research problem formulation covers two main issues: the form of legal protection for Indonesian citizens who are victims of human trafficking in Myanmar and the implementation of these international conventions within the Indonesian national legal system.This research uses a normative legal research method with a statute approach, a conceptual approach, and a comparative approach. Data sources are obtained from primary legal materials in the form of international conventions and national laws and regulations, as well as secondary legal materials in the form of relevant scientific literature. The results of the study show: First, legal protection for Indonesian citizens (WNI) who are victims of trafficking is imperatively regulated in the form of extradition, mutual legal assistance and joint investigations as well as cooperation in carrying out special investigative techniques as stipulated in UNTOC Articles 16, 18, 19 and Article 20. Second, the implementation of UNTOC in Indonesia is attempted by the Indonesian Government through rescue, repatriation, and initial assistance to victims. However, this protection is still limited to the rescue phase and has not fully touched on the physical, psychological, and social recovery aspects as mandated by the Palermo Protocol.
